Who we are
These terms are an agreement between you and The Bit Better Company of Manhattan LLC, a New Jersey limited liability company with its address at 971 US Highway 202N, Ste N, Branchburg, NJ 08876, United States. In these terms, "we", "us", and "the company" mean that entity, and "you" means the person using our software.
By creating an account, subscribing to a plan, or otherwise using our products, you agree to these terms. If you do not agree with them, please do not use the products.
What we provide
We build and operate subscription software products. Our products present information through an interface we design and maintain. Our first product is Trade The Cycle, a Bitcoin market cycle indicator.
We work to keep our products accurate and available, but we do not guarantee that any data shown is complete, current, or error free. Upstream providers change, restrict, or withdraw their data, and outages happen. We provide the products on an as available basis.
Not financial advice
Trade The Cycle, and any other market related product we publish, is an information tool and nothing more. It is not financial, investment, tax, legal, or trading advice, and no output it produces is a recommendation to buy, sell, or hold any asset. We are not a broker, a dealer, an exchange, or a registered investment adviser, and we do not manage money or execute trades on anyone's behalf.
Digital assets are volatile and you can lose all of the money you put into them. Any decision you make with your own money is your decision alone, and you should consider speaking with a licensed professional before making it.
Accounts and sign in
Some features require an account. We use passwordless sign in, which means you give us an email address and we send you a link or use a passkey. You are responsible for keeping access to that email address secure, because anyone who controls it can reach your account. Tell us promptly if you believe your account has been used without your permission.
You must be at least 18 years old to hold an account and to purchase a subscription.
Acceptable use
You agree not to do the following:
- Scrape, mirror, resell, or redistribute our data or our interface, in bulk or systematically, without written permission.
- Share your account credentials, or use one subscription to serve multiple people or an organization, unless we have agreed to that in writing.
- Interfere with the service, attempt to gain access to systems or accounts that are not yours, or work around any technical limit we put in place.
- Use the products for anything unlawful, or in any way that would put us in breach of the terms of an upstream data provider.
We may suspend or close an account that breaches these rules. Where the breach is not serious, we will normally contact you first.
Subscriptions and billing
Paid plans are sold as recurring subscriptions and are processed by our payment processor. When you subscribe:
- The plan price, currency, and billing interval are shown in full before you confirm payment.
- Your payment method is charged at the start of each billing period, and the subscription renews automatically at the same interval until it is cancelled.
- Prices are in United States dollars unless stated otherwise at checkout, and exclude any tax that we are required to collect.
- Card details are collected and stored by our payment processor. We do not see, handle, or store your card number.
If a payment fails, we will retry it and let you know. If it continues to fail, paid access ends until the balance is settled.
Price changes
We may change the price of a plan. If we do, we will give you at least 30 days notice by email before the new price applies to your subscription, and the change will only take effect at the start of a following billing period. If you do not want to continue at the new price, you can cancel before it takes effect.
Cancellation and refunds
You may cancel at any time, and your access continues to the end of the period you have already paid for. Our full policy on refunds, cancellations, and disputes is set out in the Refund and Cancellation Policy, which forms part of these terms.
Free access
Some products, or some parts of a product, are free to use. We may change, limit, or withdraw free access at any time, and free access carries no service commitment of any kind.
Our content and yours
The software, the interface, the design, and the original analysis we publish belong to us. You may use them for your own personal purposes under these terms, and nothing here transfers ownership to you. Underlying market and on-chain data belongs to its respective sources.
Disclaimers
To the fullest extent the law allows, the products are provided as is and as available, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non infringement.
Limitation of liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits, lost revenue, or trading or investment losses, arising out of or relating to the products. Our total liability to you for any claim relating to the products is limited to the amount you paid us in the 12 months before the claim arose.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
Changes to these terms
We may update these terms as the products change. When we make a material change we will update the date at the top of this page and, where the change affects your subscription, notify you by email. Continuing to use the products after a change means you accept the updated terms.
Termination
You may stop using the products and close your account at any time. We may suspend or end access if you breach these terms, if we are required to by law, or if we retire a product. If we retire a paid product, we will refund the unused portion of any subscription you have paid for.
Governing law
These terms are governed by the laws of the State of New Jersey, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in New Jersey, and you and we each consent to that jurisdiction.
